NERA Inspections

What is NERA?

NERA is the National Employment Rights Authority, and was established on foot of a commitment in the most recent social partnership agreement, ‘Towards 2016’. NERA aims to secure compliance with employment rights legislation in businesses. NERA’s primary means of contact to businesses is through inspections, which are carried out in an effort to ensure compliance with legislation.

What is a NERA Inspection?

NERA have dedicated inspectors who will undertake both “announced” and “unannounced” inspections. The inspectors will visit client premises at any reasonable time, and demand to see and inspect any relevant records, and take copies where necessary. They can also interview any relevant person they may require information from. In carrying out an inspection, the Inspector:

•Ascertains the name(s) of the person(s) who keeps and updates the records 
•Examines the records to establish that they are in compliance with the relevant employment rights legislation 
•Determines the rates of pay in respect of each employee from the rosters and the wages records presented 
•Informs the employer during the course of the inspection of any breaches of the legislation identified 
• May interview employees.

Am I at risk from a NERA inspection?

NERA’s inspection services carry out inspections across a wide number of sectors, including Hotel & Catering, Contract Cleaning, Agriculture and Construction. Each year NERA narrows its focus to specific sectors.
